Valdez. Using an online source or sources, locate the Pringle decision. Then do the following: 1. Read the dissenting opinion authored by Justice Coats. Case Briefing Pringle v. Valdez 06SC92 (2007) Court: Supreme Court Class: Civil Facts: Pringle lost con trol of the vehicle while taking Valdez home.Valdez was not wearing his seatbelt causing a series of injuries when ejected of the vehicle. Valdez requested compensation for impairment and disfigurement, and noneconomic losses. The argument lays on the ââ¬Å"Noneconomic lossesâ⬠which might fall under the ââ¬Å"pain and sufferingâ⬠under the seatbelt defense. Issue: The wording used involving ââ¬Å"pain and sufferingâ⬠and ââ¬Å"noneconomic damagesâ⬠referred to in the Seatbelt defense provision Holding: Awarding of $400,000 for physical disfigurement and impairment. Rule:The wording in dispute ââ¬Å"pain and sufferingâ⬠and ââ¬Å"noneconomic damagesâ⬠will be further evaluated. Analysis: ââ¬Å"Pain and Sufferingâ⬠and ââ¬Å"noneconomic damagesâ⬠are many times considered to be similar and by studying the demand of the case it can be ruled as been the same but using a different name. Conclusion: Non-award of $100,000 for noneconomic dam ages. Award of $400,00 for physical impairment and disfigurement. Pringle v. Valdez is obviously at first a case of Majority Opinion which in an appeal court was turned into a dissenting opinion.Part of the case held while the other was discussed, studied and adjust for an accurate ruling, in order to explain and grant a decision by the jurors and the judge according with the Statutory Interpretation of the case. During the trial in federal court, a witness for Gray repeatedly volunteered inadmissible testimony that the judge had to tell the jury to disregard. At one point, upon an objection from the defendantââ¬â¢s counsel, the witness asked, ââ¬Å"May I say something here? The judge told her she could not. Finally, after the jury left the courtroom, the witness had an angry outburst that continued into the hallway, in view of some of the jurors. The jury awarded Gray $185,000 in compensatory and $800,000 in punitive damages. Tyson believed that it should not have been liable, that the awards of damages were excessive and unsupported by evidence, and that the inadmissible evidence and improper conduct had tainted the proceedings. What courses of action may Tyson pursue? Tyson Foods entered a trial in a Federal Court after a sexual harassment case was filed.Tyson Foods follow protocol and tried to solve the issue ahead of time. During trial t he witness continued to make comments that were dismissed which were then awarded based on comments made after the hearing was completed and the company was liable to pay almost $1,000,000. 00. Based on Tyson Foods believes they should appeal the Federal Court decision due to the fact that the claims were unsupported by evidence. Also they should add the fact that the inadmissible evidence and improper conduct of the witness had tainted the proceedings issuing an unfair ruling.You own a consulting firm with 32 employees and annual billings of $29,000,000. One of your clients, whom you bill an average of $1,200,000 annually, has asked you to hire her grandson. You know that the grandson has been recently graduated from a top-20 business school. He is 31 years old, has a solid academic record, and possesses the personal and professional skills to be successful as a consultant. You also know, however, that he is a recovering cocaine addict, having struggled with the addiction for five years prior to his attending business school.Your firm has a strict no-drugs policy, which you usually interpret to exclude those who previously abused drugs. Using justice theory, justify a decision to exempt the grandson from your firmââ¬â¢s no-drugs policy. Could you make the same decision as a profit maximizer? This decision can doors to law suits for discrimination to previous applicants which applications had been denied. On the other hand, the company has the risk to loose a good client. As owner, I will first make sure to read, examine and adjust any clause related to hiring and the no-drugs policy. The words ââ¬Å"recoveringâ⬠and ââ¬Å"recoveredâ⬠are different.Hiring someone in the recovering stage, the company is breaking the no-drugs policy. If adjustments are made to the policy to accommodate applicants from this point on that are ââ¬Å"recoveringâ⬠or ââ¬Å"recoveredâ⬠drug addicts, it will be to implementing random drug tests weekly. This w ill be costly to the firm but will guarantee the no-drug policy to remain unbroken; the potential new employee must agree to this practice and the consequences based on the results. Justice Theory is based on ââ¬Å"the protection of those who are least advantaged in societyâ⬠(Mallor, J. P. , Barnes, A. J. , Bowers, T. & Langvardt, A. W. , 2010, p. 5), making changes and adjusting the policy will fall under this category. Giving a second chance to those in disadvantage in society. Maximizer ââ¬Å"requires a decision maker to maximize a businessââ¬â¢s long-run profits within the limits of the lawâ⬠(Mallor, J. P. , Barnes, A. J. , Bowers, T. & Langvardt, A. W. , 2010, p. 95) if this potential employee is capable to obey the policy and continue a successful recovery it could mean a win-win situation. You are assigned by your employer, Jay-Mart Corporation, an international discount retailer, to supervise the construction of ten new retail superstores in Shanghai, China.A ll construction is being done by a Chinese-owned contractor in compliance with Ja to those iny-Martââ¬â¢s construction standards. After an earthquake in China kills over 70,000 people, Chinaââ¬â¢s legislature passes a statute requiring new buildings to have a greater ability to withstand a large earthquake. The Chinese contractor has approached you and suggested that the new Chinese construction standards are unnecessarily high, that Jay-Martââ¬â¢s construction standards are sufficient to protect against any earthquake likely to occur, and that the cost of complying with the new Chinese construction standards will increase construction costs 20 percent.What do you do if you believe that ethical behavior requires you to maximize Jay-Martââ¬â¢s profits? A ââ¬Å"profit maximization results in ethical conduct because it requires societyââ¬â¢s members to act within the constraints of the law. This change should be shown to the companyââ¬â¢s finance department. The profits at short term could be affected by going with the construction based on the laws standards. By actually continue with the original plan the company could be liable to law suits if another natural disaster occur and the construction standards were not followed, this could affect the long run profits of the company.There are many ways to cut expenses; one that could be proposed can be to build 8 stores instead of the 10 originally proposed, this will absorbed the 20% increase to maintain the project under the stipulated budget without affecting the short term profit.References Mallor, J. Health Status of African American Men Essay
Introduction Research and technological advancement made in the United Stated of America (USA) has led to the improvement of health outcomes among the citizens of this country. People are living longer, cures are being developed daily, and many unanswered health questions are being answered then ever before. However, despite this multitude of improvement in the health status of Americans, African American men are disproportionately affected by health inequalities as compared to their Caucasian men. This paper will identify a minority group and offer relevant information of the factors that preclude minorities from quality health care, with noted barriers and interventions that will lead to improved health care and achieve the goal of quality life styles for not just one culture of people, but all people in the United States. Identifying Health disparities in African American Men African American men have the highest mortality rates and the lowest life expectancy rates among women and men in all of the racial and ethnic groups in America. The mortality rate for African American men is about 1.3 times that of White men. Life expectancy for African American men is 70 years old compared to White males living to age 76 (Xanthos, 1998). The death rate for blacks are 3 times higher than whites, due to the social and economic conditions of poverty, unemployment, stress, education, neighborhoods and their disproportionate risk for disease (Net wellness, 2014). African American men die 2.5 times more than White men from prostate cancer; African American men are 8 times more likely to die from HIV; African American men are 2 times moreà likely to develop heart disease and 3 times more likely to develop hypertension (Menââ¬â¢s Health). When compared to White men, African American men development diseases earlier, suffer from more severe diseases, and have less acce ss to medical care. The most disturbing fact to access to care is that White men are more likely to receive state of the art treatment than African American men. The exploitation of race and gender has been rooted in class status. This widespread behavior has been seen since the founding of this nation. Class has been used as a way to Indirectly suppress the poor in all sectors of life. It is the ways in which access to a variety of social goods such as the employment, housing, power; education and income are distributed in this country. Many of the questions and issues regarding this have been and continue to adversely affect the health of African American men. Having the understanding that there are barriers that are difficult to address in any one health promotion, and being able to rethink how these barriers function in the lives of African American men, will result in likely success in promoting quality healthcare. How is Health promotion defined by this group? Life style plays a major role in the prevalence of chronic disease. Given the factors that impact racial discrimination concerning the health care of African American men, we can start by promoting policies which address all racial discrimination. We must strengthen anti-discrimination legislation that addresses unemployment. We reform and improve the interaction with African American male students, by increasing funding to the African American communities, which would lead to having more marketable African American men in the work force. We must also address the racial biases in the criminal system, reducing the number of African American in our jails. If we use the landmark law, the Affordable Care Act (ACA), we will enable over 30 million people with much needed health insurance coverage. With the provisions of the ACA not only will health insurance coverage be accessible, but provisions related to disparities be reduced, data collection and reporting will be more effective and inclusive of quality improvement and prevention. This act will promote prevention and wellnessà programs, giving all people more control over their health care (Sebelius, 2011). According to the Healthy People 2020, one of the goals is to ââ¬Å"achieve health equity, eliminate disparities and improve the health of all groups.â⬠By tracking death rates, acute and chronic diseases, injuries and all health related behaviors, this will assist health care providers become more proficient in diagnosing and providing treatment in the areas of cardiovascular disease, cancer, HIV and diabetes while being culturally competent (Healthy People, 2020). Our local, regional, and national organizations must take an action role in providing guidelines to develop comprehensive health care interventions that are designed for people of all cultures (Argondezzi, 2001). The successful strengthening of infrastructures to prioritize the challenges of reducing health disparities of African American men will achieve the much needed sources to eliminate unequal treatment. Exponents for social justice and equality have continued to disseminate information on the importance of addressing this problem. Many professional organizations, governmental and non- governmental bodies such as WHO and Public Health Organizations as well as individuals like Paul Farmer and Barbara Ehrenreich have been active on the forefront either directly or indirectly in advocating for social justice. Given the multi-faceted nature of the problem Barbara Ehrenreich a writer by profession and PhD by education, conducted an experimental study on class in the United States of America by self experiencing the reality of living as a lower class citizen with a lower and unskilled paying job in her book entitled; Nickel and Dime (Ehrenreich, 2008). Nickel and Dime is a non fictitious writing that depicts the social class of America. Barbara Ehrenreich, is a reporter and a writer who decided to experiment on how unskilled low wage workers are able to live on their minimum wages. To experiment the effects of living as a lower class citizen in this country, she decided to live in three different states month by month while living on just what she made as an unskilled worker. Her decision first took her to Key West, Florida, where she begun working as a waitress in a restaurant. She was able to find an affordable living accommodation in a trailer on the outskirt of the city. Acknowledging that one job could not pay her living expenses, she sought aà second job as a hotel maid. The physical demands of both jobs resulted in Barbara leaving her second job. She was unable to complete the whole month before moving to Portland to continue her next experiment (Ehrenreich, 2008) . In Portland, she found a job as a maid with a residential housekeeping service. There she also took a second job as a dietary aide in a nursing home in order to meet her monthly livingà expenses. She was indirectly forced to work seven days a week to meet the need of paying her monthly rent, food and clothing. She became an advocate for her co-workers while working as a maid, even though, she was able to win a day off for one of her co-workers who had sustained an injury at the job but afraid of losing her job kept working while injured (Ehrenreich, 2008) . Barbaraââ¬â¢s final destination on her experiment was in Minneapolis, Minnesota where she was hired to work at a Wal-Mart store, putting clothes on shelves. In Minnesota she was not able to afford an expensive apartment due to her salary. The apartment vacancy rate in Minneapolis was so low that she had to stay in motels until she completed her experiment. Barbara had advocated for the lower class through her book, regarding the experience that lower class citizens go through in terms of self esteem, housing, education and power. She highlighted the deplorably conditions and humiliation that they face each day at work. She summarized some of the reasons why wages are kept low, the rationale for the humiliation, the yelling on and the psychological derailment of their self esteem that keeps them in a lower salary while the upper class reap off all the benefits from their hard labor in an exchange for coffee and donuts at times instead of a pay raise (Ehrenreich, 2008). There is a direct correlation between lower class and poor health. Conclusion Health disparities are often measured in terms of income, education, wealth, politics or influence and occupation. The combination of these factors including race and gender often determine our social worth. The experiment of Barbara Ehrenreich is a great example of discrimination, disparity, and she was a woman. African American men experience much more and receive much less. Looking at different cultures is not new to nurses, even Florence Nightingale analyzed her population to determine the care and services that were needed. Understanding and influencing culture, economics, the physical environments of our patientââ¬â¢s health practices, while assisting them to access to care will lead to promising outcomes (Jones, 2014). Introduction This is a report that shows a comparison between both Partnership and Limited Liability Partnership organization and to advise Mr. Tan on the business organization that is more likely to fit his needs for setting up a new consulting business. For this particular project, our group assumed that Mr. Tan used to be an accountant working for a big accounting firm and is now looking to set up a small accounting consultancy business. 1Process Required to Setup Business Organization Below are the processes to setting up a partnership and a limited liability partnership business organization respectively: 1.1Partnership Firstly, the partners have to fill with the Registrar an application for approval and reservation of partnership name. After the application is being approved, a partnership is required to be registered online via BizFile with ACRA through a professional business registration firm if both of the partners are not local citizen. Following are the information needed: 1) Proposed name of the Partnership 2) Particulars of the partners/managers (foreign passport or Singapore ID) 3) Residential address of the partners/managers 4) Consent to Act as Manager and Statement of Non Disqualification to Act as Manager 5) If partner is a company: Registration details of the company 6) Singaporean or PR must pay Medisave 7) Declaration of compliance ACRA will then send an email of notification confirming the registration. (enterAsia Information Services Pte Ltd, 2010) 2Legal Characteristics of Each of the Business Organizations 2.1The Characteristics of Partnership (ASSAR, 2011) Two or more persons: Partnership involves business by a group of persons. There must be at least two persons to bring partnership into existence. Although there is no maximum number required in the Partnership Act, the Companies Act has placed a maximum limit 20 people in a business. A company must be registered if there are more than 20 people in the business. Contractual Relation: A partnership is a contractual relationship arising out of an agreement among the partners, a person does not become a partner out of his status as is the case in joint family. Persons entering in partnership must be competent to enter into a contract as it is essential, and the agreement among partners may be oral or in writing. A written agreement or deed is preferred because it helps in resolving some disputes among partners later on. Lawful Business: A partnership agreement only exists in a lawful business. Sharing of profits: An agreement among partners must include the sharing of profits and losses. A charitable trust cannot be called partnership because there is no sharing of profits. Profit sharing is only a superficial evidence of partnership but not a conclusive proof. The employees of a business may also share profits but they are not the partners. No Separate Legal Existence: A partnership firm is not a legal entity of its own. This means that the firm and the partners are one and the same. A firm is only a name to the collective name of partners and no firm can exist without partners. The rights and liabilities of the partners are the rights and liabilities of the firm. Management of the firm vests in partners who are its owners also. Unlimited Liability: Every individual partner is liable jointly and severally for the obligations of the partnership firm. Therefore, if assets of the business are not sufficient to meet the liabilities of creditors then private property of partners can be used to meet them. The creditors can claim their dues from anyone or all the partners. If these liabilities are met by one partner then he is entitled to receive rateable contributions from other partners. Restriction on Transfer of Shares: No partner can transfer his shares to an outsider without the unanimous consent of all other partners. It is based on the principle that a partner being an agent of the firm cannot delegate his authority unilaterally to outsiders. Utmost Good Faith: The very basis of partnership business is good faith and mutual trust. Each and every partner should act honestly and fairly in the conduct of business. A firm cannot be run if there is suspicion among partners. Partners must have faith in each other for running the business smoothly. 2.2The Characteristics of Limited Liability Partnership (LLP) A limited liability partnership is a business structures that operates similar to a partnership organizational structure. The difference is the limited personal liability afforded to each member of the company. Each partner is responsible for their own actions while conducting business. LLPs are tailored for professionals, such as doctors, lawyers and accountants. (Howell, 2012) Every Partner Equal: Each partner is an equal member in a LLP company. They decide together on various company issues, such as the name of the business, where it is located and how it is going to be operated. Partners also share equally in the profits and losses of the business. The number of people in LLP must not exceed 20. Limited Liability Protection: Each partner in this type of company is protected against the actions of the other partners which results in a lawsuit. For example, if one partner is subject of a malpractice claim and loses in court and have to pay damages, the other partners are not held financially responsible. However, partners in a LLP are liable for the obligations of the company such as loans used to purchase equipment and utility expenses. Pass Through Taxation of Profits: A limited liability partnership company is taxed similar to a business formed under the partnership and sole proprietorship organizational structures by a process called pass-through taxation. The company profits are not taxed at the company level but insteadà are ââ¬Å"passed throughâ⬠to the partners to be reported on their individual tax returns. This prevents the double taxation that occurs in corporations where profits are taxed at the company and shareholder levels. 3Advantages and Disadvantages of Partnership and LLP 3.1Partnership Advantages of Partnership 1. Capital: Due to the nature of the business, the partners would contribute their share of capital to start up the business. Hence, the more partners there are, the higher the amount they could put into the business. This would give the partners better flexibility and greater potential for growth. It also means more potential profit, which would be equally shared between the partners. 2. Flexibility: It is generally easier to form, manage and run a Partnership. There are fewer restrictions in a partnership than in companies, in terms of the laws governing the formation. As the partners have the only say in the way the business is run without the interference of shareholders, they are far more flexible in terms of management, as long as all the partners can agree. 3. Shared Responsibility: Partners would be able to share the responsibility of the running of the business. This would allow the partners to make the most of their abilities and potential. Instead of dividing the management and taking equal shares of each business tasks, they would be able to divide the work according to their skills. Thus, if one partner is good with figures, they could deal with the book keeping and accounts, while the other partners might have different niche areas and specialize in different tasks. 4. Decision Making: Partners share the decision making and can help each other out when needed. With more partners means more brainstorming could be in place and the information they came out with could be picked out forà business ideas and for the solving of problems that the business may encounter. (Adrain, 2010) Disadvantages of Partnership 1. Disagreements: One of the most common disadvantages of partnership is the possibility of disagreements between the partners. People often have mixed ideas on how the business should be run, the task arrangements and are picky about what the best interests of the business are. All these might lead to arguments which might not only endanger the business, but also the relationship of those involved. That is why it is always preferred to draft a deed of partnership during the formation period to ensure that all partners are aware of what are in place in case of disputes and prepare for the procedures if a partnership is dissolved. 2. Agreement: As the partnership is jointly run, it is crucial that all the partners agree with decisions that are being made. This means that in some situations there is less freedom with regards to the management of the business. This is especially so compared to sole traders, where the sole trader need not seek agreement from anyone but himself. 3. Liability: Ordinary Partnerships are subject to unlimited liability, which means that each of the partners shares the liability and financial risks of the business equally. This might put of the idea of partnership for some people, as they might not want to take the risk. 4. Profit sharing: As partners share the profits equally, it can lead to inconsistency where one or more partners are not contributing a fair share of effort into the running or management of the business, but still reaping equal rewards. 3.2Limited Liability Partnership Advantages of Limited Liability Partnership (Janus Corporate Solutions, 2008) 1. Separate Legal Identity: A limited liability partnership has a separate legal identity. They can own properties, at the same time they canà enter into contracts, and sue or be sued in itsââ¬â¢ own name. 2. Limited personal liability: The partners of the limited liability partnership will not be held personally liable for any business debts incurred by the limited liability partnership or the wrongful acts of their partners. A partner may, however, be held personally liable for claims from losses resulting from his own misconducts or omission. 3. Perpetual succession: Any changes in the limited liability partnership (e.g. resignation or death of its partners) do not affect its existence, rights or liabilities. 4. Ease of compliance: Compliance requirements are more complex than sole proprietorship but simpler than a private limited company. Disadvantages of Limited Liability Partnership (Janus Corporate Solutions, 2008) 1. Formation of limited liability partnership requires a minimum number of 2 partners at all times. 2. Individual partners can commit the partnership to formal business agreements without the consent of their partners. 3. Limited liability partnership lacks the ease of ownership transfer and investment that a company structure provides. 4. There are no corporate tax benefits: Tax exemptions are available to private limited companies but are not available to limited liability partnerships. A limited liability partnership is treated as tax transparent which means that limited liability partnerships are not taxed as an entity. Instead each partner is taxed on their share of the profits as per the personal income tax rates. 4Analysis on Choosing the Business Organization Since Mr. Tan is setting up a business for accountancy consulting, he shouldà opt for a Limited Liability Partnership organization instead of a Partnership. Mr. Tan is currently new to the business world, and might not have found a partner he could fully trust yet; therefore it is also to his advantage if his partner were to act wrongfully or if there is a change in partners, since in LLPs, partners are not liable for losses to outsiders arising from acts of another partner as compared to an unlimited liability if he were to go into a Partnership. In addition, the LLP is also not subject to full financial reporting and disclosure requirements, such as those on capital contributions and changes to capital (ACRA, 2005). This is an advantage to Mr. Tanââ¬â¢s business. Since the business is small, minor changes to capital will not have to be subjected to full reporting and disclosure. Furthermore, as mentioned earlier, LLPs are tailored for accountants. In this respect, the picture can be divided into two parts: one part showing Christ and Peter while the other depicting Mathews and his companies. Both these parts are in stark contrast with each other. Christ and Peter represent spirituality. They do so through their simple clothing and the fact they do not wear any shoes. The absence of footwear reflects on the fact that these men are down to earth without any love for material objects. Mathews and his companions reflect the worldly life. This is apparent in the way they dress: fashionably in the attire that was trend during the time period when the painting was created. Also the presence of the coins and the preoccupation of some companions with the coins reflect on the worldly life enjoyed by Mathews and his companies (Benner, 129). Another symbol apparent in the painting is the way the painting has been divided into two parts. Here Caravaggio uses his typical style of chiaroscuro where he paints a stark contrast of light and dark in the painting (Cunningham and Reich, 360). Between Christ and Mathews, Caravaggio has painted a dark area and the hand of Christ e xtending towards the dark spot. The light in the picture comes from the side where Christ is standing. This play of light seems to be intentional on the part of the painter as he depicts Christ as a beacon of hope and light for Mathews while taking him away from a life of materialistic love and wastage. Itââ¬â¢s not exactly known which country was responsible for the war though Germany is strongly believed to be responsible for the out break of the war. Through the Schlieffen plan German was supposed first to invade France through Belgium then Russia before it had mobilized. Germany was also a major partner in the triple alliance and itââ¬â¢s perceived that Hungary would not have risked war with Serbia without full backing of Germany through the blank check given on 6th, june1914. However, on the other hand the war started first as conflict between Hungary and Serbia after the assassin of Archduke Franz Ferdinand and his wife in Hungary. Debate on Auditor Independence Abstract Recently of corporate collapse in the US, Australia, and elsewhere, regulatory attention has been drawn to the published of auditor provided non-audit services (NAS) and audit client relationship. This assignment aims to debate on auditor independence by providing evidence regarding the relationship between non audit services and provide consulting services at a lower cost for their audit clients. In tracking the development and identify the key stages and the changes that took place in approaches to external auditing. The two listed companies selected for arguments are Enron Corporation versus Chartered Semiconductor Manufacturing Ltd. Enron Corporation (former NYSE ticker symbol ENE) was an American energy company based in Huston, Texas. It was one of the worlds leading electricity, nature gas, paper and communications companies.1 Chartered Semiconductor Manufacturing Ltd (Chartered) is one of the worlds top dedicated semiconductor foundries in Singapore. It provides comprehensive wafer fabrication services and technologies to semiconductor supplier and system companies. They are taken a reference for the arguments that influenced by the changes which have reported and analyses the effect. Research on non audit service provision impairs auditor independence, differential incentives drive auditor behavior. Introduction Auditor independence is a cornerstone of the auditing profession, a crucial element in the statutory corporate reporting process and a key prerequisite for the adding of value to an audited financial statement (Mautz and Sharaf, 1961). However, recent account scandals, involving corporations such as Enron in the US, HIH Insurance in Australia have cast doubt over the independence of auditors and overall value of auditing. These legislative interventions however have occurred despite limited and mixed empirical evidence of these proposed threats to auditor independence. Furthermore, some basic questions underlying this debate remain unresolved. For example, à ¢Ã¢â ¬Ã
â What factors influence a companys decision to purchase NAS from its incumbent auditor?2 The provision of NAS reduces investors judgments of auditor independence, audit quality and the attractiveness of the firm investment but not their auditor knowledge or financial statement reliability judgment. This assignment have consider two areas of literature which relating the theories and model of auditor independence. It also relevance on NAS found in current professional, regulatory frameworks, reviewed and summarized original theoretical and empirical studies but have excluded commentaries and opinion. The Big Five audit firms (Ernst Young, Arthur Anderson, Deloitte Touche, PricewaterhouseCoppers and KPMG) charger higher audit fees for initial engagement. It has prediction that where audit fees are disclosed publicly. The audit firms lower their audit fees to accept new clients when they also provide more lucrative non audit services. It is no actual loss of audit independence despite the loss of perceived independence of the Big 5 firms. The provision of NAS by audit firms for their audit clients are popular in the current market and continuous debate over auditor independence. NAS may include consulting service such as systems design, compliance-related service, taxation, book-keeping or other services relating to the accounting records or financial statement of the audit client; financial information systems design and implementation; actuarial service; internal audit outsourcing service; management functions or human resources; dealer and investment advisor The emerged from the Enron collapse has been the extent to which audit firms are providing NAS to their audit clients. The fees generated by NAS have been rising more rapidly than audit fees. This has led to widespread beliefs that provision of NAS can cause the auditors to compromise their independence. There are two main concerns which auditors may not stand up to management because they wish to retain the additional income from NAS which is in managements gift. Second provision of service to management may lead the auditor to indentify too closely with management and lose skepticism. It reveals that nearly all firm purchase non audit services from their audit firm to their audit client. Although the big 5 auditing firm continue to maintain their independence is not impaired by these services , recently problems at Enron, WorldCom and other public firm brought accounting and auditing concerns to the attention of Congress and the public. Newly passed legislation prohibits NAS, including financial information services and internal auditing services (Sarbanes-Oxley Act 2002). Non audit services (NAS) are defined as all services provided by an auditor that are not considered as an audit. The Sarbanes Oxley Act (SOX) reduce the number of non audit services that an auditor are required pre-approval by the audit committee of such extended engagement (Rouse, 2005). Most banned services related to consulting or advisory services that might create conflict of interests for independent auditors (Banham, 2003). The banned non audit services include: 1. Book-keeping or other services related to the accounting records or financial statements of the audit client. The auditor is considered not independent when he provides book-keeping services for audit client. It involves with an inherent conflict of interest, and auditor should examine accounting records or financial statements prepared appropriate. 2. The native Americans were called the creeks. The reason for the creeks being made is because the white men took there land. The white men thought the creeks were going to attack so they attacked first. the creeks fought back against the white men. This started a war. Davy helped the creeks fight against the white men.
